Terms and Conditions
Rental Equipment Payment:
Pricing and equipment availability is only guaranteed once a credit card number is provided as a security deposit. All orders should be paid in full prior to or at the time of delivery. Cash payments will require a form of ID, which we will take a record of in the form of a picture, at the time of delivery. We accept cash, Visa, MasterCard, Discover and PayPal. Payments can be made securely online at www.sunshinesaltwaterbeachsupplies.com. Additionally, we reserve the right to charge the card on file if equipment is broken or lost due to negligence.
Cancellations must be made two (2) weeks prior to arrival, to avoid the cancellation fee. Cancellations made within two weeks prior to your arrival will have a 10% ($15 minimum) fee assessed.
No refunds will be given once delivery has been made. However, refunds will be given if we are unable to set equipment up on the beach due to inclement weather or hurricane evacuation.
All items are thoroughly cleaned and sanitized prior to daily setups.
Lost or Damaged Equipment:
Upon arrival, inspect all items and immediately report any discrepancies. Otherwise, you will be charged for repair or replacement of items. Renter will be responsible for any damage or theft to equipment, should any occur. The credit card on file will be charged replacement value for the item. Beach chairs, umbrellas and other outdoor beach equipment should not be left on the beach unattended. If the wind picks up you may need to lower umbrellas to prevent wind damage.
Delivery, Set Up and Breakdown:
All items will be delivered, set up by Sunshine & Saltwater Beach Supplies to your location by 10am daily. All items will be broken down and picked up by Sunshine & Saltwater Beach Supplies by 5pm daily. Delivery, set up and pick-up is FREE with minimum daily rental of $150.
Hold Harmless/Release of Liability:
Lessee assumes all responsibility for equipment while in possession and agrees to return it in the same condition. Lessee shall be liable for any loss, theft, destruction or damage of said leased rental equipment. Lessee agrees to pay for the regular replacement cost of items lost or damaged beyond repair. Lessee should inspect gear for safety prior to use. In consideration of the rental agreement between Lessee and Sunshine & Saltwater Beach Supplies, LLC, Lessee acknowledges and agrees to the following terms: Lessee understands that there exist certain risks of injury from the use or misuse of such items, including the potential risk of serious injury, disability or death from the use of such items. Lessee knowingly and freely assumes all such risks, both known and unknown, and assumes full responsibility for the use of such items. Lessee understands the risks associated with the use of such items and understands the safety concerns regarding the items. Lessee agrees for themselves and on behalf of their heirs, assigns, personal representatives and next of kin to release, hold harmless and agree not to sue Sunshine & Saltwater Beach Supplies, LLC, the lessor of all such items lessee has agreed to rent, their officers, agents and employees, with respect to any and all injury, disability, death, loss or damage to person or property, whether caused by the negligence of the lessor or otherwise, except that which is the result of gross negligence or wanton misconduct. Lessee understands that this release of liability covers each and every item which lessee has agreed to rent. Lessee further agrees that this release of liability shall be governed by the laws of the State of Florida. Lessee has read and understands this release of liability and fully understands its terms and fully understands they have given up substantial rights by signing the Equipment Order Form and sign it freely and voluntarily without inducement.
